Terms of Service

These Terms of Service ("Terms") govern your use of the Viera platform ("Platform", "we", "us"), operated by Viera, with registered address in Tirana, Albania. By creating an account or using the Platform, you agree to these Terms in full. If you do not agree, do not use the Platform.

1. Who Can Use Viera

You must be at least 18 years old to create an account. By registering you confirm that you are 18 or older and have full legal capacity to enter into a binding contract. Brands must be legally registered businesses or sole traders acting in a professional capacity. Viera reserves the right to refuse or terminate accounts at its sole discretion.

2. What Viera Is

Viera is an influencer marketing marketplace that connects brands with content creators operating primarily in Albania, Kosovo, and the Albanian diaspora. The Platform provides tools for campaign creation, creator discovery, application management, booking, content review, invoicing, and related communication. Viera is a technology intermediary — it does not guarantee the commercial outcome of any campaign.

3. Creator Obligations

• Deliver content that meets the specifications and deadline agreed in each campaign booking.
• Clearly label all sponsored content as required by applicable advertising regulations (Albanian Consumer Protection, EU Directive 2005/29/EC, and the rules of each social platform).
• Not submit content that infringes third-party intellectual property rights, is defamatory, obscene, or unlawful.
• Maintain accurate profile information including follower counts and engagement metrics.
• Not circumvent Viera's payment system by arranging off-platform payments with brands discovered through Viera during the term of a campaign or within 12 months of an introduction.

4. Brand Obligations

• Provide accurate and complete campaign briefs.
• Pay invoices within the agreed payment terms (default: 30 days).
• Not use creator content beyond the scope, duration, or territory agreed in the campaign without additional written consent and compensation.
• Ensure that all products, services, and campaigns promoted on the Platform comply with applicable law.
• Not approach creators introduced via Viera for off-platform transactions during or within 12 months of an active campaign without Viera's written consent.

5. Platform Fees and Payments

Viera charges a platform service fee on each transaction. The current fee is 15% of the agreed campaign or booking value, added on top of the creator's stated price and invoiced to the brand. This fee rate is displayed at the time of booking confirmation and on all invoices.

Payments are processed via Stripe. By using payment features you also agree to Stripe's Terms of Service. Viera does not store card numbers or raw payment credentials.

Creator payouts are initiated by Viera after an invoice is settled and the booking is marked complete. Viera aims to process settlements within 5 business days of confirmed payment receipt. Settlement timelines may vary and Viera does not guarantee same-day disbursement.

6. Refunds and Cancellations

Platform service fees are non-refundable once a booking is confirmed. If a creator fails to deliver agreed content within the specified timeline and no extension has been mutually agreed, the brand may raise a dispute by contacting support@viera.al. Viera will review disputes on a case-by-case basis and its decision is final. Refunds, where granted, exclude the platform service fee.

7. Intellectual Property

Creators retain ownership of all content they produce unless the campaign agreement explicitly transfers ownership. By accepting a campaign, the creator grants the brand a non-exclusive, royalty-free licence to use the delivered content for the purpose, channels, duration, and territory stated in the campaign brief. Any usage beyond these parameters requires a separate written agreement.

The Viera name, logo, and platform design are the intellectual property of Viera and may not be used without prior written permission.

8. Content Standards and Moderation

Viera may remove any content that violates these Terms, applicable law, or the rules of linked social platforms. Repeated violations may result in permanent account suspension. Viera is not liable for user-generated content and does not pre-screen submissions before publication.

9. Prohibited Conduct

• Creating fake accounts, inflating follower/engagement metrics, or misrepresenting identity.
• Spam, phishing, or distributing malicious software through the Platform.
• Circumventing platform fees or payment obligations.
• Scraping or automated data extraction without written permission.
• Uploading content that is unlawful, defamatory, sexually explicit, or violates third-party rights.

10. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind, express or implied. Viera does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. Viera does not guarantee that any campaign will achieve a particular reach, engagement, or commercial outcome.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Viera's total liability for any claim arising out of or related to these Terms is limited to the fees actually paid by you to Viera in the three calendar months immediately before the event giving rise to the claim. Viera is not liable for indirect, incidental, consequential, special, or exemplary damages, including lost profits or loss of data, even if advised of the possibility of such damages.

12. Force Majeure

Viera is not liable for delays or failures in performance caused by circumstances beyond its reasonable control, including natural disasters, government action, internet outages, or third-party platform outages (e.g. Supabase, Stripe, or Vercel downtime).

13. Account Termination

You may delete your account at any time by contacting support@viera.al or using the account deletion option in your settings. Viera may suspend or terminate your account for breach of these Terms, without notice where the breach is serious. Outstanding payment obligations survive termination.

14. Changes to These Terms

Viera may update these Terms at any time. We will notify active users of material changes by email or platform notification at least 14 days before the change takes effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Albania. For users resident in the European Union, mandatory consumer protection rights under your local law are not affected. Disputes should first be raised by emailing legal@viera.al. If not resolved within 30 days, disputes shall be subject to the jurisdiction of the courts of Tirana, Albania, unless applicable EU law requires otherwise.
